Jimmie Duncan, who spent 27 years on death row, was granted bail and subsequently released in November 2025, marking a significant development in his long-standing case. Duncan was originally convicted in 1998 for the first-degree murder, rape, and drowning of his then-girlfriend Allison Layton Statham’s 23-month-old daughter, Haley Oliveaux. A court filing from Duncan's legal team detailed that forensic dentist Michael West “forcibly push[ed] a mold of Mr. Duncan’s teeth into the child’s body,” thereby creating the marks. New evidence suggests Oliveaux’s death was an “accidental drowning,” further weakening the prosecution's original case. Judge Sharp also considered Duncan's lack of prior criminal history in his decision to grant bail, noting that “the presumption is not great that he is guilty.”

Duncan posted a $150,000 bond and was released on November 26, 2025, although his case remains under review by the Louisiana Supreme Court. While not officially exonerated, his legal team asserts that the judge’s ruling provides “clear and convincing evidence showing that Mr. Duncan is factually innocent,” viewing his release as a crucial step towards complete exoneration. Even his ex-girlfriend, Allison Layton Statham, believes Duncan is innocent, testifying that she thinks her daughter accidentally drowned and “wasn’t killed” due to illness. However, the case is not fully resolved; prosecutors are still seeking to reinstate Duncan’s conviction and the death penalty, arguing based on the 1994 grand jury indictment, posing a continued risk to Duncan's newfound freedom.
